Terms of Usage

GPLForever (“Provider”) provides software and website services to you subject to the following Terms of Service (“TOS”). If you do not agree to these Terms of Service, you should not use gplforever.com website.

Product License

The products provided on gplforever.com are licensed under the GNU General Public License (GPL). All items in the GPLFOREVER directory are developed by third-party developers and redistributed by GPLFOREVER. GPLFOREVER is not associated with or the developers of any items featured on this site and does not offer any additional author services such as author’s support and license keys.

Product Support

We provide support for any inconvenience related to the direct experience with us, such as problems with downloads, navigation, or any issues associated with our site or services. You can contact us through the contact form or by writing to contact@gplforever.com.

We do not provide support for issues related to the author of the product, such as customizations or author-related problems like version failures, among other issues directly related to the developer.

Third-party products provided are supported by their authors and not by GPLFOREVER. Please review the support terms provided by the author of a product before purchasing it.

Product Updates

As soon as we are notified about a product update (user or author email), we download the product, check for any problems or pre-activation requirements. Then, we pre-activate it and publish it on our site.

The publication date of each product may vary depending on factors such as the author, contract, need for pre-activation, etc.

All individual purchases include lifetime updates. If you purchase a membership, you will have updates and access for as long as the membership is active.

The lifetime update service will only be valid as long as there is a valid contract or membership with the product developer/reseller. In most cases, contracts are renewed and remain unaffected. However, if the supplier/promoter unilaterally waives the contract renewal or if we encounter any problems with the promoter, this contract or any related issues, we will not be obligated to continue providing the latest version of the products.

Once we are notified of a product update, either by the user or the author, we proceed to download the updated version. We thoroughly check for any issues and ensure it is pre-activated before publishing it on our site.

Please note that the publication dates of each product may vary depending on factors such as the author’s agreement, contractual obligations, or the need for pre-activation. While individual purchases come with lifetime updates, membership-based access grants updates and site access for the duration of the active membership.

However, it is important to understand that the lifetime update service will only remain valid as long as there is a valid contract or membership with the product developer or reseller. In the event that the developer or reseller unilaterally terminates the contract renewal or any issues arise between us and the promoter, we are not obligated to continue providing the latest versions of the products.

Product Prices

We do not guarantee the availability of any particular item on our website. We reserve the right to modify or suspend all or part of the downloads, with or without prior notice. Additionally, we may add new downloads with or without notice. The prices of any product are subject to change at any time by posting the changes on our website. However, the prices for all individual purchases have been set at $2.99 since 2023.

Memberships

Prices for “General Memberships” in 2023 are as follows:

  • Monthly membership: $9
  • Yearly membership: $25
  • Lifetime membership: $30

Please note: If you require it, we can migrate your account to a premium lifetime membership.

Customer Accounts

Customers must create an account when purchasing any product. They are responsible for maintaining the confidentiality of their password and are prohibited from sharing and/or distributing their account login details. Customers are fully responsible for all activities that occur in their account and agree to immediately notify the Provider of any unauthorized use of their account or any other security breach.

The Provider will not be responsible for any loss or damage arising from the customer’s breach of these terms. Please be aware that the Provider requires all users to be over 18 years of age in order to have a customer account. By creating an account, we assume that you are above 18 years old.

Account Termination and Suspension

The Provider reserves the right to suspend and/or terminate any user account without notice, at its sole and absolute discretion. No refunds will be provided to customers whose accounts have been terminated.

Examples of reasons for termination include:

  1. Abusive behavior and/or excessive negativity towards staff.
  2. Repeated defamatory, malicious, and/or false statements that include slander against the Provider and/or attempts to persuade potential customers not to purchase the Provider’s products.
  3. Misuse of the server services of the site, technical abuse of resources, or any type of practices that threaten the services and/or equipment of GPLForever.
  4. The Provider reasonably believes that your account has been compromised, shared with others, or for other security reasons.
  5. Sharing, transferring, or reselling the user account. The accounts are nontransferable.

Product Delivery

After the customer’s payment, the login information for their account will be sent via email to the provided email address during registration. This process may take up to 30 minutes after purchase but usually occurs between 1 and 15 minutes. Access to the downloads is typically granted immediately upon payment validation.

Refunds

Due to the nature of the service, we do not offer a refund service, except in the following case:

  • Problems with the download of a product in a simple purchase that cannot be resolved by our team within the next 24-48 hours after payment validation or user notification.

We will not provide a refund if the product does not meet your expectations or needs since it is the responsibility of the customer. To avoid such situations, all products have links to the author’s details.

Memberships are not eligible for a refund service.

Business Use of Our Goods and Services

If you are using our services on behalf of a business, that business accepts these terms. It will hold Provider and its affiliates, officers, agents, and employees harmless and indemnify them from any claim, suit, or action arising from or related to the use of the goods or services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorney’s fees.

Provider does not provide any warranty

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER PROVIDER NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT ITS GOODS OR SERVICES. FOR EXAMPLE, PROVIDER DOES NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE GOODS OR SERVICES, THE SPECIFIC FUNCTION OF THE GOODS OR SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE GOODS AND SERVICES “AS IS”.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Liability for Our Products and Services

WHEN PERMITTED BY LAW, PROVIDER, AND PROVIDER’S SUPPLIERS AND DISTRIBUTORS WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PROVIDER, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID PROVIDER TO USE PROVIDER’S GOODS AND/OR SERVICES.

IN ALL CASES, PROVIDER, AND ITS SUPPLIERS AND DISTRIBUTORS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Miscellaneous

No Waiver: If you fail to comply with these terms and GPLForever does not take immediate action, it does not mean that GPLForever is waiving or giving up any rights, including the right to take action in the future.

By using the GPLForever website and its services, you agree to abide by these Terms of Service. If you do not agree with any part of these terms, please refrain from using the gplforever.com website.

Updates to TOS: The Terms of Service may be updated periodically, but never retroactively. Notice of modifications will be posted on this page and will take effect no less than 10 days after posting. However, immediate changes may be made for new functionality, legal requirements, or urgent legal reasons.

Other Guidelines or Terms: In the event of a conflict between these TOS and specific terms for a particular GPLForever service, the terms specific to that service will prevail.

No Third-Party Beneficiaries: These terms govern the relationship between GPLForever and the user and do not create any rights for third-party beneficiaries.

Severability: If any provision of these TOS is found to be unenforceable, it will not affect the validity of the remaining provisions.

Intellectual Property Rights

All software and website services provided by GPLForever remain subject to the GNU General Public License (GPL). The products available on GPLForever.com are licensed under the GPL and are developed by third-party developers. GPLForever is not affiliated with the developers of these items and does not provide additional author services such as author support or license keys.

Product Support

GPLForever offers support for any issues directly related to the user’s experience with their platform, such as problems with downloads, navigation, or site-related concerns. Users can contact us through the provided contact form or by emailing contact@gplforever.com.

However, please note that we do not provide support for issues related to the original product authors. This includes customization requests or version-specific problems that are directly associated with the developers. It is advisable to review the support terms provided by the product authors before making a purchase.

Customer Accounts

Customers are required to create an account when making a purchase. It is the responsibility of customers to maintain the confidentiality of their passwords and not share or distribute their account login details. Customers are fully liable for all activities carried out under their accounts and must promptly notify GPLForever of any unauthorized use or security breaches.

The Provider will not be held responsible for any loss or damages arising from the customer’s failure to comply with these account security obligations. Additionally, all users are required to be at least 18 years old when creating a customer account. By creating an account, we assume that you are over 18 years of age.

Account Termination and Suspension

GPLForever reserves the right to suspend and/or terminate user accounts at its sole and absolute discretion, without prior notice. No refunds will be provided to customers whose accounts are terminated.

Examples of reasons for account termination include:

  1. Abusive behavior or excessive negativity towards our staff.
  2. Repeated dissemination of defamatory, malicious, or false statements that slander GPLForever or attempt to dissuade potential customers from purchasing our products.
  3. Misuse of our server services, including technical abuse of resources or engaging in practices that threaten the integrity of GPLForever’s services or equipment

Reasons for account termination (continued):

  1. The reasonable belief that the user’s account has been compromised, shared with others, or for other security-related reasons.
  2. Sharing, transferring, or reselling user accounts. User accounts are non-transferable.

Refunds

Due to the nature of our service, we do not offer refunds except in the following case:

  • If there are issues with downloading a product in a simple purchase that cannot be resolved by our team within 24-48 hours after payment validation or user notification.

We do not provide refunds if the product does not meet your expectations or needs, as it is the responsibility of the customer to review the product details and make an informed decision. To avoid such situations, we provide links to the author’s details for each product.

Refund services are not applicable to memberships.

Business Use of Our Goods and Services

If you are using our services on behalf of a business, the business accepts these terms and agrees to hold GPLForever and its affiliates, officers, agents, and employees harmless from any claim, suit, or action arising from the use of our goods or services or the violation of these terms. This includes any liability, expenses, claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.

No Warranty Provided

Except as expressly stated in these terms or additional terms, GPLForever and its suppliers or distributors do not make any specific promises or warranties regarding the goods or services. We do not make commitments regarding the content within the goods or services, their specific functionality, reliability, availability, or their ability to meet your specific needs. We provide the goods and services “as is.”

Some jurisdictions may provide certain warranties, such as the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we exclude all warranties.
